RA Dr. Peter E. Ouart is one of the internationally recognized experts in the area of life science, for more than 15 years. He advises companies worldwide, including leading manufacturers in the agrochemical industry.

Leading German companies and international manufacturers belong to the permanent clients of the firm. The firm advises companies on the implementation of phytosanitary approval procedures vis-à-vis the German authorities involved, such as the Federal Office of Consumer Protection and Food Safety (BVL), the Federal Office for Risk Assessment (BfR) and the Federal Environment Agency (UBA). In addition to numerous publications and lectures between 2005 and 2020, Dr. Peter E. Ouart, has obtained from 2016 to 2019 important judgements of the administrative courts in agrochemical law, which have answered and clarified fundamental legal questions of the EU-regulation.

Other key areas of the firm are industrial property rights, product defence, anti-counterfeiting (product defence against illegal imports; trademark protection) as well as all legal issues concerning EU parallel trade and the necessary approvals of the national plant protection authorities are therefore also part of the firm’s permanent tasks.

Since 2005, Dr. Peter E. Ouart has conducted more than 100 proceedings and obtained groundbreaking decisions of the European Court of Justice, the Federal Court of Justice and numerous German Higher Regional Courts. RA Dr. Peter E. Ouart is also the long-standing president of the German Society for Inheritance Law. (DGE) with more than 100 members (lawyers, notaries, tax consultants, auditors) and a total of more than 300 professionals in Germany and abroad. The DGE and its members are particularly concerned with all aspects of corporate succession as well as international inheritance law and the EU Inheritance Regulation (EU ErbVO), which has been in force since 2015. In numerous inheritance cases involving foreign assets, especially when foreign assets are involved in the estate, the German DGE members cooperate with their German-speaking colleagues in EU and non-EU countries. The further training courses offered by the DGE focus on the aforementioned fields of law with all aspects of tax law. The DGE’s further training events are regularly moderated by lawyer Dr. Ouart, who is also the author and co-editor of the “German Commentary on Inheritance Law” published by Heymanns Verlag (now Wolters Kluwer Verlag).

PFLANZENSCHUTZRECHT

Nach den beiden von uns erwirkten rechtskräftigen Grundsatzurteilen des Verwaltungsgerichts Braunschweig ( Urt. v. 30.11.2016 -9 A 27/16-; -9 A 28/16-), mit denen das Verwaltungsgericht grundsätzliche Feststellungen zum Regelungsgehalt der VO (EG) Nr. 1107/2009 getroffen hat und sich im Ergebnis unseren Ausführungen angeschlossen hat, haben wir aktuell im Jahr 2018 erstmals in der Rechtsprechung der BRD rechtskräftige Urteile der zu­stän­di­gen Verwaltungsgerichte erwirkt, mit denen die deutschen Zu­las­sungs­be­hör­den ver­pflich­tet wurden, zuvor verweigerte oder verspätete Zu­las­sungs­ent­schei­dun­gen zugunsten der Hersteller und zur besseren Produktvielfalt zu erteilen.

SPORTRECHT

Im Sportrecht ist die Kanzlei in den Bereichen Fußball-, Motorsport- und Ver­bands­recht engagiert. Die Kanzlei vertritt seit rund 20 Jahren zahlreiche Vereine der 1. und 2. Bundesliga u.a. den SC Freiburg aber auch Regionalliga- und Amateurvereine. In dieser Zeit wurden nicht nur die vertraglichen Rahmenbedingungen zum Aufbau von Nachwuchs- und Leistungszentrum geschaffen, sondern auch im Pro­fi­be­reich zahlreiche Transfers abgewickelt, zahlreiche sportrechtliche und zivilrechtliche Verfahren geführt (u.a. Wetts­kan­dal Sapina/Hoyzer/Jansen) Grundsatzurteile vor dem internationalen Sportschiedsgericht CAS erwirkt und darüber hinaus zahl­rei­che sportgerichtliche Verfahren vor dem DFB geführt.
